BeMedResident is an educational platform designed to assist medical students and applicants in preparing for medical residency interviews. The Application provides:

  • Interview question practice and feedback
  • Educational articles and resources
  • AI-powered analysis and feedback on interview responses
  • Learning materials related to residency application processes

Service Limitations: This Application is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Authentication

3.1. Account Creation

To use certain features of this Application, you must create an account. We provide authentication services through third-party providers:

  • Google Authentication: You may sign in using your Google account. When you choose this option, you grant us permission to access certain information from your Google account as authorized by Google's authentication process.
  • Apple Sign-In: You may optionally sign in using your Apple ID (when available). This service is subject to Apple's Terms of Service and Privacy Policy.
  • GitHub Authentication: You may optionally sign in using your GitHub account (when available). This service is subject to GitHub's Terms of Service and Privacy Policy.

3.2. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that all information provided during account creation is accurate and current
  • Notifying us immediately of any unauthorized use of your account

AI Service Providers Currently Used:

  • DeepSeek: We utilize AI models provided by DeepSeek. Responses generated using DeepSeek models may vary and are subject to the limitations inherent in AI technology.
  • Together AI: We utilize a variety of AI models provided by Together AI, which offers access to multiple state-of-the-art language models. The specific model used may vary depending on availability and service requirements.
  • Google: We utilize AI language models provided by Google LLC. Use of Google models is subject to Google's Terms of Service and API usage policies.
  • OpenAI Whisper: We utilize OpenAI's Whisper models for speech-to-text (STT) functionality to transcribe audio recordings. Use of Whisper models is subject to OpenAI's Terms of Service and API usage policies.

AI Service Limitations and Disclaimers:

  • Model Availability: We reserve the right to use different AI models or providers depending on availability, performance, cost, and service requirements. The specific AI provider or model used for your request may not be disclosed.
  • Third-Party Dependencies: These AI services are operated by independent third parties. We are not responsible for the availability, accuracy, or functionality of these AI services.
  • Service Changes: AI providers may update, modify, or discontinue their services. We are not liable for any interruptions or changes to AI-provided functionality.
  • No Guarantee of Results: AI-generated content may contain errors, inaccuracies, or may not meet your specific needs. The quality and accuracy of AI responses are not guaranteed.

User Data and AI Services:

When you use features that require AI processing, your input data may be transmitted to these third-party AI providers for processing. Please see Section 5 (Data Privacy and Security) for details about how we handle your data.

5. Data Privacy, Sharing, and Security

5.1. Our Data Practices

We Do NOT Resell Your Data: We do not sell, rent, or trade your personal information or user data to third parties for marketing or commercial purposes.

We Do NOT Share Your Data (Except as Required by Law): We do not share your personal information or user data with third parties except:

  • Legal Requirements: As required by applicable United States laws, regulations, legal processes, court orders, or government requests. This includes but is not limited to:

    • Responding to valid subpoenas, court orders, or other legal processes
    • Complying with applicable laws and regulations
    • Protecting our rights, property, or safety, or that of our users or others
    • Investigating potential violations of these Terms or illegal activities

  • Service Providers: With trusted service providers who assist us in operating the Application, such as:

    • Cloud infrastructure providers (e.g., Cloudflare) necessary for hosting and delivery
    • AI service providers necessary for delivering AI-powered features (including language models and speech-to-text services such as OpenAI Whisper)
    • Authentication providers (Google, Apple, GitHub) as part of the authentication process
    • Analytics and monitoring services necessary for service improvement

    These service providers are contractually obligated to protect your data and use it only for specified purposes.

  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, where your data may be transferred as part of the transaction.

5.2. Data Security

Security Measures: We implement reasonable security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

Third-Party Data Handling: When data is processed by third-party AI providers or other service providers, it is subject to their respective privacy policies and security practices. We are not responsible for the security practices of third parties.

User Responsibility: You are responsible for:

6.7. Data Privacy and Security Risks

IMPORTANT DATA SECURITY WARNINGS:

  • DO NOT SUBMIT PERSONAL INFORMATION: Users should NOT submit:

By using this Application, you agree to:

  • Not use the Application in any way that could damage, disable, overburden, or impair our servers or networks
  • Not attempt to gain unauthorized access to any portion of the Application or any systems or networks connected to the Application
  • Not use automated systems (bots, scrapers, crawlers, etc.) to access, copy, extract, or harvest content from the Application without our express written permission

10.2. Refund Process

  • Reason for refund request

Refund requests are reviewed within 3 business days. Approved refunds are processed within 5-7 business days and returned to the original payment method.

10.3. Exceptions and Limitations

Refunds are not provided in the following circumstances:

  • Requests made more than 30 days after the original charge date
  • Accounts terminated for violation of these Terms of Service
  • Subscriptions obtained through fraud, abuse, or unauthorized payment methods
  • After using more than 10 practice questions (beyond free tier)
  • For reported "change of mind" after the guarantee period has expired
  • Multiple refund requests from the same user (limited to one lifetime refund per account)
